Jury Finds that Escort, Inc. and Beltronics USA, Inc. Infringe Two GPS Radar Detector Patents

On July 3, 2012, a jury found that Escort, Inc. (www.escortradar.com) and Beltronics USA, Inc. (www.beltronics.com) infringed numerous claims in U.S. Patent Nos. RE39,038 and RE40,653. In particular, the jury held that Escort’s Passport 9500i, Passport 9500ix, and Passport iQ radar detectors, together with Beltronics USA’s GX65 radar detectors, directly infringe claims 3, 5, 6, 7, 25, 26, 27, and 28 of U.S. Patent No. RE39,038 (“the ‘038 patent”) and claims 22, 31, 32, 33, 38, and 41 of U.S. Patent No. RE40,653 (“the ‘653 patent”). The jury also found that Escort and Beltronics contributed to the infringement of claims 3, 5, 6, 7, 25, and 28 in the ‘038 patent and claims 22, 24, 31, 32, and 33 in the ‘653 patent. The jury further found that Escort’s Passport 9500ix and Passport iQ radar detectors, together with Beltronics USA’s GX65 radar detectors, infringe claim 24 of the ‘653 patent.

The ‘038 and the ‘653 patents are owned by Hoyt Fleming, an Idaho inventor of 37 U.S. Patents. On March 10, 2009, Mr. Fleming filed a complaint (Case Number 1:09-cv-00105-BLW, United States District Court District of Idaho) alleging that Escort and Beltronics USA infringed the ‘038 and the ‘653 patents. Escort alleged that certain claims of the Fleming patents were invalid because Steven Orr, while working for Cincinnati Microwave, Inc. in 1996, made Fleming’s invention earlier in time than Fleming. On July 3, 2012, after a trial spanning more than two-weeks that included live testimony from Steven Orr, John Kuhn (Escort’s Vice President of Engineering), and John Larson (Escort’s President), the jury refused to invalidate the above claims of the Fleming patents based upon Steven Orr’s alleged prior work.

“I am very happy with the jury’s verdict because the jury held that Escort and Beltronics are infringing two of my patents. I am looking forward to a future trial in which another jury will also find that Escort and Beltronics and many of their retailers, including Best Buy and Amazon.com, are willfully infringing a third of my radar detector patents, U.S. Patent No. RE41,905,” said Mr. Fleming. Mr. Fleming is represented by Mr. Michael S. Dowler ofPark, Vaughan, Fleming, and Dowler LLP in Houston, Texas. Escort and Beltronics USA are represented by Gregory F. Ahrens and Brett A. Schatz and of Wood Herron & Evans in Cincinnati, OH together with Steven B. Andersen of Holland and Hart in Boise, ID.

Federal Judge Rules that Escort, Inc. and Beltronics USA, Inc. Infringe GPS Radar Detector Patent

On December 14, 2011, the Chief U.S. District Judge, District of Idaho, ruled that Escort, Inc. (www.escortradar.com) infringed U.S. Patent No. RE39,038. Specifically, the Court ruled that Escort’s Passport 9500i, Passport 9500ix, and Passport iQ radar detectors, together with Beltronics USA’s (www.beltronics.com) GX65 radar detectors, infringe claims 18, 45, 47, and 48 of U.S. Patent No. RE39,038 (“the ‘038 patent”). The Court also granted partial summary judgment of infringement with respect to each of those products regarding ‘038 patent claims 1, 3, 5, 6, 8, 25, 26, 27, and 28, and U.S. Patent No. RE40,653 (“the ‘653 patent”) claims 22 and 26. A redacted version of the Court’s 58 page order was unsealed earlier today. A copy of the 58 page order can be obtained at: https://www.yousendit.com/download/T2...

The ‘038 and the ‘653 patents are owned by Hoyt Fleming, an Idaho inventor of 36 U.S. patents. In early 2008, Escort declined to purchase the ‘038 patent. Approximately one year later, on March 10, 2009, Mr. Fleming filed a complaint (Case Number 1:09-cv-00105-BLW, United States District Court District of Idaho) alleging that Escort and Beltronics USA infringed the ‘038 and the ‘653 patents.

Escort alleged that certain claims of the patents were invalid because Steven Orr, working for Escort, invented the same device earlier in time than Fleming. However, on December 14, 2011, the Court denied Escort’s motion to invalidate claims of the Fleming patents based upon Steven Orr’s alleged work for Escort. The Court also denied Escort’s motions to strike Fleming’s expert reports and strike Fleming’s contention that Escort willfully infringes Fleming’s patents.

In contrast to denying Escort’s motions, the Court granted the overwhelming majority of Mr. Fleming’s motions for judgment on Escort’s defenses, including: (1) laches; (2) equitable estoppel; (3) prosecution history estoppel for certain claims; (4) ownership of Mr. Fleming’s patents; (5) inequitable conduct; (6) intervening rights on certain claims; and (7) anticipation of claim 1 in view of a Japanese patent.

In the order the Court stated that Escort’s interpretation of the Court’s rules was“absurd”, that Escort’s arguments were “in fact contrary to law”, and many of Escort’s expert “opinions are irrelevant”.

“I am very happy with the order. The Court ruled that Escort is infringing one of my patents. I am looking forward to a short trial in June so that I can prove that Escort’s infringement is willful and obtain an injunction to stop Escort’s infringement,” said Mr. Fleming.

Mr. Fleming is represented by Mr. Michael S. Dowler of Park, Vaughan, Fleming, and Dowler LLP in Houston, Texas. Escort and Beltronics USA are represented by Brett A. Schatz and Gregory F. Ahrens of Wood Herron & Evans in Cincinnati, OH. The Court has set trial for June 18, 2012 in Boise, ID.

Escort is a portfolio company of Falconhead Capital LLC (http://falconheadcapital.com), an investment firm in New York, New York. David Morros, the Founder and CEO of Falconhead, Zuher Ladak, a partner of Falconhead, and David Yarnell, an Operating Partner of Falconhead, sit on the board of Escort.

BlueStar Case Solutions Develops EDD Toolkit E-Discovery App

Chicago based litigation support services provider launches free e-discovery calculator application for smartphones.

BlueStar Case Solutions, Inc. (BlueStar), a litigation support services provider and consultancy, recently launched EDD Toolkit, a free e-discovery application (app) for smartphones. The app features a Cost Estimator, Time Estimator, Conversion Table and Glossary for common e-discovery questions with regards to ESI (electronically stored information) processing, document review and production. The EDD Toolkit e-discovery app is a useful application for attorneys, paralegals, in-house counsel and litigation support staff who quickly need answers about a particular e-discovery project.

“We are very excited about all the positive reviews we have gotten so far, including the enthusiastic comments we received last week at LegalTech New York,” says Desiree Salomon, BlueStar’s Marketing Manager. “It’s the ultimate e-discovery ‘cheat sheet.’”

The EDD Toolkit provides valuable reference resources and quickly estimates how much e-discovery may cost and how long the process may take. Along with a glossary of terms and a data-to-documents or pages conversion calculator, the application is quickly becoming an essential tool for the e-discovery practitioner.

EDD Toolkit e-discovery app’s full list of features includes:

Cost Estimator
E-Discovery, and the costs associated with it are a large portion of a client’s litigation spend. Using industry averages, BlueStar’s EDD Toolkit Cost Estimator estimates how much a user defined amount of data or number of documents for review could cost.

Time Estimator
The Time Estimator will estimate how long the ESI processing and review steps may take in litigation, and also has the ability to calculate how long it can take to scan paper documents into an electronic format.

Conversion Table
The Conversion Table calculates how many documents or pages may be found in a user defined amount of data. Broken down by common email and document formats, the user can easily estimate how much data exists in a tangible measurement, by the number of documents or pages.

Glossary
E-Discovery terminology and jargon can be perplexing to paralegals, attorneys, and anyone involved in litigation support, therefore the Glossary feature provides definitions for most common e-discovery related terms via a quickly accessible interface.

The EDD Toolkit is currently available for iPhone and Android, while BlackBerry and Windows 7 versions are scheduled for release later this month. To learn more or to download the EDD Toolkit app for free visit: http://www.bluestarcs.com/resources/app-support.

In August 2009, the National Highway Traffic Safety Administration (NHTSA) and Toyota launched an investigation relating to the unintended acceleration of some of its vehicles. On September 29, 2009, the NHTSA announced that Toyota was recalling floor mats on approximately 4.2 million vehicles, which allegedly caused the accelerator pedals in the vehicles to become stuck in the depressed position, leading to uncontrollable and rapid acceleration of the vehicles. On January 21, 2010, Toyota recalled 2.3 million vehicles produced in the years 2005 through 2010 due to accelerator pedals on those vehicles becoming stuck in a depressed position, causing unexpected and unsafe acceleration. To date, Toyota has recalled a total of 5.3 million vehicles due to defects in accelerator pedals, which can unexpectedly become stuck in place and send the vehicle into rapid, uncontrollable and unsafe acceleration.

The complaint charges Toyota with negligence, breach of express and implied warranty, unjust enrichment and violations of the New Jersey Consumer Fraud Act. Quigal Launches New Search Site for High-Achieving Attorneys

Quigal, LLC announced today that it was launching its attorney search web site for residents of Massachusetts. Quigal’s site allows the public to search for attorneys who have impressive educational backgrounds or substantial work experience in complex legal matters and allows users to communicate with multiple attorneys quickly and easily. During the initial launch period, attorneys authorized to practice law in Massachusetts are invited to register with the site free of charge until April 1, 2010.

For Quigal attorney members, a unique feature of the web site is that the number of attorneys who can register is limited to ten per zip code, which increases each registered attorney’s visibility vis-à-vis potential clients.

The inspiration for Quigal came from attorneys and clients who complained about the poor quality of existing directory services, both online and print, recalled Renate Harrison, Quigal co-founder. “My colleagues complained that existing directories contained so many lawyers that the odds of engaging a client were too low to justify the expense, while users felt overwhelmed by the sheer number of attorneys they had to choose from and the multiple pages of information they had to fill out,” Harrison noted. “So I asked what I thought was a simple question: how can we improve the way clients find lawyers online? I believe Quigal is the answer.”

As of today, Massachusetts residents can begin using Quigal. Quigal is built on the idea that users should have confidence in the quality of attorneys made available to them on attorney search sites, and that the number of registered attorneys should be limited, so that each attorney has a realistic opportunity to engage clients. Key features of Quigal include:

• Search: Quigal enables the public to search for attorneys by zip code, city, state, practice area, or law school attended. Quigal also permits potential clients to search for attorneys who are available for a live chat.

• Exclusivity: Quigal attorney members who subscribe to a zip code always appear on the first page search results for that zip code. A maximum of ten attorneys can register for each zip code.

• Quality: Quigal only registers attorneys who have graduated from a top-tier law school or who have substantial work experience managing complex legal matters.

• Ease of Use: Quigal offers several options for potential clients to contact attorney members. A simple online query form and attorney profiles with full contact information appear on every search results page. Also, a live chat option allows potential clients to chat real-time with attorneys. Quigal also allows its registered attorneys to link to their social and professional networking sites (e.g. Facebook, LinkedIn, Twitter, etc.).
In the coming months, Quigal will be rolling out its web site nationally, as well as introducing new site features.

Are you interested in registering with Quigal? Please visit Quigal’s website at www.quigal.com. For more information about Quigal, please contact Renate Harrison.

Hill Schwartz Spilker Keller LLC Announced The Successful Utilization Of Remlox, A Patent Pending Forensic ESI Collection Tool, In Africa, Central America, Europe And The United States

National firm Hill Schwartz Spilker Keller LLC (HSSK) announced the successful utilization of Remlox(tm), a patent pending forensic ESI collection tool, in Africa, Central America, Europe and the United States.

The use of Remlox allowed the firm to remotely acquire forensic images of hard drives located throughout Nigeria, Costa Rica, England and various locations in the United States. Before Remlox, such sector-by-sector forensic imaging required onsite collection by one of the firm’s computer forensics experts. HSSK distributed Remlox to several hundred custodians, avoiding the cost and logistical issues of on-site imaging. Complete, encrypted forensic images were verified in HSSK’s Houston Computer Forensics lab, the nation’s first non-governmental lab to be accredited by the American Society of Crime Laboratory Directors/Laboratory Accreditation Board (ASCLD/LAB).

“By remotely acquiring forensic images, Remlox answers a great need in the industry.” said David Greetham, Computer Forensics practice director at HSSK.

“Remlox now allows attorneys to forensically acquire ESI, without the usual high costs associated with traveling to different remote locations, while negating the risks associated with self collection.”

Remlox runs directly from a pre-configured external USB drive that is sent to the custodian and requires no installation. It performs a tamper proof system audit of the acquired computer and has the option to forensically acquire the contents of RAM. Greetham added, “Using Remlox is quick and simple. On one occasion, we sent over 350 units to individual locations in two days and had the data back in our lab for verification within one week. On other occasions, we have utilized Remlox in locations that would simply be cost prohibitive to travel to.”

Remlox utilizes AES 256 bit encryption, to protect the integrity of the forensic images in transit.

Hill Schwartz Spilker Keller LLC (www.hsskgroup.com) is a leader in providing Computer Forensic services. HSSK’s Houston lab holds the distinction of being the first non-governmental lab in the United States to obtain ASCLD accreditation. HSSK also provides business valuation, litigation consulting and forensic accounting services from its offices in Houston, Dallas and Washington D.C.

Schillings to discuss privacy and reputation management issues at Legal Weeks Private Client Forum

Schillings, one of Britain’s top law firms dedicated to safeguarding the privacy and reputations of international corporates, brands, celebrities and high-profile business people, will be represented by senior partner Keith Schilling at Legal Week’s Private Client Forum. The main theme will be “Assessing Risk in a Volatile World”, which will be looking at changes the international wealth market has faced in 2008 and the new risks brought about in an ever increasingly volatile market.

Keith Schilling, senior partner at Schillings, will participate in a panel discussion on the topics of privacy, reputation management and human rights and will discuss, along with fellow panelists, how the world’s high-net worth individuals are in a constant battle with the media to protect their own privacy and reputations.

The conference will examine the major issues that have arisen following the advent of the credit crunch and the economic strain currently being suffered on a global scale. Increased pressure from regulatory authorities in Europe and the US government also spell uncertain times for the world’s financial safe havens.

These developments and more will provide the basis for a three day programme for the world’s leading private client lawyers.

The first day of the conference will offer a view of the impact of the credit crunch and how the shift of wealth globally has brought about new risks in wealth management.

The second day will feature a Q & A style debate on the future of international financial centers and a discussion assessing the effects of new US exit tax laws which will form a wider discussion on the reach of exit, gift and inheritance taxes globally.

The third day will see Keith Schilling, recently voted one of the 1000 most influential people in London, join a European panel discussion on privacy and reputations. His fellow panelists include Basile Ader from the French law firm Ader, Amigues et Jolibois; Professor Dr. Matthias Prinz from the German law firm Prinz Neidhardt Engelschall and Jennifer McDermott from Withers in the UK. The panel will outline the differences in privacy laws across a number of jurisdictions and the steps to take to avoid unwanted media attention and what to do if it arises.

Keith Schilling said about the conference, “At this time of volatile market conditions, the threat of a global recession and fears about the security of individuals’ wealth, the media are increasingly focusing on the private wealth of high-profile people. We are seeing a trend in the media towards ‘money being the new celebrity’ and we are working with our high-net worth clients to advise them how to protect their reputations and manage their own and their families private lives. This conference is on at a time of unprecedented financial turmoil and proves just how important an issue it is.”

About Schillings:
Schillings is one of Britain’s top law firms dedicated to safeguarding the reputations of international corporations, brands, celebrities and high-profile business people. The firm’s track-record in defamation, privacy and copyright cases, as well as
