New Lawyer for the Alleged Ukrainian Child Porn Tycoon

Maksym Shynkarenko, who has been charged with 32 counts of advertising child “adult content” to child exploitation enterprise and money laundering, has retained the Bukh Law Firm, P.C. of New York as his criminal defense counsel in his upcoming trial. He was arrested in Thailand in 2009 and had been fighting extradition to the United States since that time. Mr. Shynkarenko was extradited from Thailand earlier this summer (June 2012) and was allowed by the court to have time to prepare for trial in the Federal Court.

The investigation of the 33-year-old Ukrainian and his alleged child pornography network by U.S. investigators has claimed 560 child pornography convictions across the country since it first began. Mr. Shynkarenko was indicted in New Jersey (case #2:2008-cr-00625) as that is where U.S. investigators first uncovered his alleged website on the computer of a New Jersey resident which was then shut down in 2005. The trial will take place in the U.S. District Court in that jurisdiction.

Mr. Shynkarenko is a native of Kharkov, Ukraine and the indictment has charged him as running a worldwide network of several child pornography sites with two co-conspirators, one from the Ukraine and one from Russia. While this is alleged to be a very profitable enterprise for all involved, Mr. Shynkarenko was granted the services of a public defender by the Judge at the time of his indictment. He is now represented by federal criminal defense attorney, Arkady Bukh.

At the time of the hearing after his extradition, the Associated Press reported that a spokesman for Ukraine’s Foreign Ministry stated that detectives had found absolutely no evidence that Mr. Shynkarenko had committed a crime and they are concerned about the “rights of our citizen”. The Shynkarenko family is very concerned and they do presume him innocent. Ukranian officials are quite concerned about this case as they feel that U.S. prosecutors have a poor reputation regarding the rights of their citizens. If convicted, Maksym Shynarenko could face up to 20 years in prison on each count.

U.S. District Court Judge William H. Walls has set the pre-trial conference in this case to March 26, 2013. The Bukh Law Firm, P.C. has several criminal defense attorneys experienced in the defense of this type of case in Federal Court.

Western European Study Highlights Key Selection and Retention Factors Used by In-House Counsel

LexisNexis (www.lexisnexis.com), a leading provider of content and technology solutions, today announced results from the latest LexisNexis® Martindale-Hubbell® study on law firm and client relationships in Western Europe. The report, ‘The Selection and Retention of Law Firms in Western Europe’, reinforced the view that in initial selection processes, in-house counsel want their law firms to understand their business needs, objectives and culture, whereas the quality of the team overall has the most weight in determining whether firms are retained.

Conducted during January and February 2012 in association with The Global Legal Post, the survey reflects the views of 219 in-house counsel across 16 Western European countries, half of which have revenues of at least €1.3 billion.

The top five factors that in-house counsel use in the selection and re-hiring of law firms are:

The most important factor – by no means a surprise – is understanding the client’s business needs, with 72% of respondents rating this as ‘very important’. Speedy response times, client service and communication skills and expertise and reputation of the individual lawyer are regarded as the next group of favoured attributes. Interestingly, cost is not a key factor in initial selection processes.

Common ‘magic ingredients’ of relationships are dedication and chemistry, alongside expertise, quality of ability/competence and cost/fees. Proficiency in business and legal skills alone are only part of the picture. The ‘people buy people’ adage is borne out in the results, with over one in four companies prioritizing this factor on their list of requirements, whilst one in two want a trusted advisor.

“These trends in selection and retention factors are consistent with similar surveys that we have undertaken in other world regions,” Derek Benton, director of International Operations at Martindale-Hubbell commented.

“From a business development perspective, the message is simple. To get noticed in the identification and selection stages – whether communicating via their own or third party website, blogs, articles, social media or tender documents – firms need to engage buyers by firstly showing that they understand their sector and how that impacts their day-to-day business.”

Law firms also need to focus on building their relationships with the Chief Legal Officer (CLO), as over two-thirds of respondents state CLOs had primary responsibility for making decisions to appointment firms. Surprisingly, procurement departments are only involved in appointing firms for one in 20 companies surveyed.

Getting on panels seems to be a key objective for many law firms, but surprisingly the survey finds that 72% do not use law firm panels and, of these, 78% are not planning to put a panel in place. If a firm has not made it onto a panel, the findings suggest that they are not excluded indefinitely from selection as panels tend to be reviewed every two or three years.

When asked what factors would lead a law firm to be selected for a second time, respondents cite the quality of the team as a whole (80%), followed by their knowledge of the business (76%) and cost/approach to billing (71%). Overall standard of service remains critical, as poor service is the fastest route to being removed from a preferred list, according to 93% of survey respondents. Firms still need to keep an eye on costs, and ‘unfair or unclear billing’ can lead to relationships being terminated. Indeed, achieving better value for money has been the main driver to review panel firms in recent years.

Nevertheless, most law firms are seen as being sensitive to the budgetary pressures of legal departments (60%) and offer value-added services, with free training topping the list. However, the survey suggests they need to do more to listen and learn from feedback. Nearly all surveyed (93%) said they would be willing to participate in formal client satisfaction surveys, yet only half have actually been asked to participate.

The biggest challenges facing in-house lawyers in the next year are cost control, (62%), increased workload (52%) and litigation/risk managements (44%). The research shows mixed fortunes ahead for law firms with 20% of companies decreasing legal budgets, whilst 22% expected to increase spend.

Approximately 19,000 copies of the magazine will be included with The New York Times on Saturday, February 5, 2012. In addition, selected North Carolina attorneys will be in a special advertising feature in the February 2012 issue of Charlotte magazine.

Schillings Recommend Key Changes To Privacy And Reputation Protection

Schillings, the leading law firm protecting the privacy and reputations of businesses and high-profile individuals, has released the findings of its recent research entitled – ‘A private life in the public eye’. The research report sets out a ‘Blueprint for change’ to help people protect their privacy and reputation without compromising the vital principle of freedom of expression. The launch of the report coincides with the Government’s DCMS Select Committee’s comprehensive report into Press Standards, Privacy and Libel.

The overarching aim of the research was to discover what it means to be in the public eye today and where the line should be drawn to separate the part of a person’s life that should remain private. The key areas of interest included: Attitudes towards privacy; Importance of legal measures; Due prominence of apologies; The effectiveness of the Press Complaints Commission; Dissatisfaction with press reporting; Prior notification and the future challenges facing reputation protection.

The research provides evidence that people are dissatisfied with the current position regarding reputation and privacy. The opinions of the audience presented in the report do not necessarily represent those of Schillings. An area of common ground is the view showing that whilst it is important to permit publication of matters that are genuinely in the public interest, too often reputations are damaged, and privacy invaded, by the publication of stories that are untrue, or where the main aim is to satisfy salacious curiosity about the lives of the rich and famous irrespective of the distress caused to them, their families and their friends.

Gideon Benaim, Partner at Schillings, who led the research project commented: “Schillings has been at the forefront of developing privacy law in this country and has set legal precedent providing everyone the right of protection in respect of their home life, their children and medical information, as well as other areas considered private. This means their private life should not be reported by the press unless it is truly a matter in the public interest. However, in some areas we find the media don’t make the correct distinction between ‘public interest’ and ‘of interest to the public’ which are quite different concepts.”

Schillings concluded that the aims of existing laws are sound. But in practice, they frequently fail to achieve a satisfactory balance between the public interest, the truth and privacy. The report recommends three key reforms to reputation laws under the proposal called the ‘Blueprint for change’; each of which are supported by the recommendations in the DCMS report.

– The press should have to notify people before publishing stories that will seriously invade their privacy.
– It should be easier to obtain injunctions preventing the publication of untrue allegations.
– Introduce a pre-publication system to resolve disputes.

How to Negotiate Effectively and Peacefully With the IRS

When a consumer is interested in filing bankruptcy, they will normally contact a bankruptcy attorney in their area or simply walk into their office with no prior appointment. The average consumer will also want to know how much it will cost to file bankruptcy, at which time the attorney must gather enough information about their financial situation to provide a reasonable quote for services.
